Trademark Agent

Bhole IP Law is a boutique intellectual property law firm based in Toronto. Our team combines deep legal expertise with a client-first approach, serving public institutions, entrepreneurs, startups, and established businesses across Canada and internationally.

The Role

We're looking for a Class 1 Trademark Agent to join our growing trademark prosecution team. You will work directly with clients to provide strategic guidance and execute on that guidance. Your practice will include all aspects of prosecution, from searches to filing (Canadian and internationally), examination, and opposition. Candidates that are also licensed lawyers will have the opportunity to work on IP agreements.

Responsibilities

  • Prosecution & Strategy: Advise clients on the registrability of trademarks, conduct clearance searches, and prepare/file trademark applications with the Canadian Intellectual Property Office (CIPO)
  • Office Actions: Review, strategize, and respond to examiner reports (Office Actions) regarding non-compliance, confusion, or distinctiveness.
  • Portfolio Management: Manage trademark portfolios, including renewals, assignments, licensing, and chain of title recordations.
  • Contentious Proceedings: Represent clients before the Trademarks Opposition Board (TMOB) in opposition and cancellation proceedings.
  • International Coordination: Collaborate with foreign associates to manage global IP rights.
  • Client Advice: Provide actionable advice on trademark licensing, infringement, and enforcement strategies.
  • Business Development: Take on business development objectives as appropriate to your level of experience and personality type.
  • Process Improvement: Collaborate with others in the firm to continuously improve efficiency in our operations.

What We're Looking For

Required:

  • Class 1 Trademark Agent in good standing with CPATA
  • Exceptional communication skills and keen attention to detail
  • Ability to manage multiple deadlines and meet deadlines independently
  • Understanding of, and willingness to use, AI tools

Nice to Have:

  • Lawyer in good standing with LSO
  • Experience with IP agreements (registered IP assignments, complex license agreements, joint venture/collaboration agreements, software agreements)
  • A desire to grow the business, with a willingness and ability to pursue business development initiatives
