Senior Intellectual Property Counsel

Job Description:
The Intellectual Property Counsel will be responsible for managing Recochem’s extensive global IP portfolio and providing legal advice on a broad range of complex legal and regulatory matters related to intellectual property, marketing, advertising, and privacy. The successful incumbent will also support the business in its related compliance efforts and draft, review and negotiate agreements and contracts related to client facing materials and provide sound legal risk analysis in relation to compliance and legal processes. This is a hybrid position, which may be based out of the organization’s head office in Montreal, Quebec or its regional office in Milton, Ontario.
Responsibilities:
- Support to the General Counsel and business units by providing strategic legal and compliance advice and services to clients, particularly with an emphasis on the intellectual property (patent, trademark and copyright) portfolio
- Manage the organization’s global intellectual property portfolio, including the management of any legal team members assigned to the intellectual property group and outside counsel and IP professionals across multiple jurisdictions
- Advise the business units and R&D team on the protection of the organization’s intellectual property assets and devise cost effective strategies to maximize coverage
- Draft, review, analyze and advise on a wide range or transactional and commercial agreements and legal documents, including license agreements
- Develop and enhance agreement templates
- Review marketing materials and product labels
- Maintain current knowledge of the law, specific to the areas of intellectual property, marketing, advertising and privacy and monitor legal trends to provide advice and deliver internal trainings on intellectual property and marketing-related topics
- Advise on consumer litigation trends, marketing strategies and product claims
- Assist in the analysis of legal and compliance requirements and risk mitigation associated with the organization’s activities as they relate to intellectual property or product claims
- Research and respond to general legal inquiries from internal clients that relate to intellectual property and compliance matters, and provide advice on appropriate legal action to be taken
- Undertake other reasonable duties as requested
Qualifications & Skills Requirements:
- LL.B or JD from a recognized law school and licensed to practice law in one or more jurisdictions in Canada or the United States
- 5 years or more of post-qualification practice developing expert knowledge as either in-house counsel or with a well-recognized law firm, focusing on IP, advertising and marketing and regulatory compliance
- Strong client skills, the ability to work autonomously on projects, flexibility to adapt to changes and able to work in a fast-paced environment
- Effective and concise communications in a variety of formats and venues to a wide audience
- Bilingualism in both English and French verbal is highly desired
- Registration as a Patent and Trademark Agent with industry-related expertise is a definite plus
