The Scope of Patent Agent Privilege Post-Janssen

Janssen Inc. v. Sandoz Canada Inc., 2021 FC 1265 is the first decision of the Federal Court interpreting the Patent Act’s newly-introduced section 16.1, which provides for patent agent privilege. In this webinar, our expert panel will discuss the Federal Court’s commentary, including what communications the privilege established by section 16.1 does and does not attach to.

 This webinar will explore:

  • the 2016 amendment to the Patent Act introducing s. 16.1;
  • the 3-part test under s. 16.1;
  • the Janssen decision, including its implications for the scope of patent agent privilege; and
  • professionals’ best practices in light of the Janssen decision, and more generally, to preserve privilege.
