The Role of an Inventor in Patent Litigation

Every patented invention is made by one or more inventors, and inventors are also a feature of all patent litigation. The presenters will discuss the role of an inventor, the rights and obligations relating to inventors, and practical tips for both patentees and defendants.

The discussion included:

  • What rights and obligations do patentees and defendants have when it comes to inventors? What about the inventors themselves?
  • Practical tips relating to locating inventors and their documents, preparing an inventor as a witness, and requesting or compelling attendance (e.g., letters rogatory).
  • Inventor discovery – proper scope of examination, how can it be used, whether to have an inventor also act as a party representative, and dealing with undertakings and refusals.
  • Inventor evidence at trial – relevance and persuasive value.
