LEARNING OBJECTIVES

This module of the Patent Agent Training Course is an advanced, practical program intended to enhance the patent agent trainee’s skills relevant to patent infringement and validity and to increase chances of success in the Canadian Qualifying Patent Agent Exam: Paper B (Validity) and Paper D (Infringement).

The delivery of this online course is a combination of virtual workshops, live and on demand lectures and distance education learning.


 VIRTUAL WORKSHOPS AND LECTURES: FEBRUARY 1 – 3 | 2023
 12:00 – 5:00 PM (ET) | DAILY

The on demand lectures and virtual workshops will introduce the core principles surrounding patent infringement and validity, as well as winning strategies for passing the Canadian Qualifying Patent Agent Exam (Paper B and Paper D):

         Review of relevant jurisprudence | Claim construction and interpretation | Basis for infringement and remedies
         Limitation periods | Essential v. non-essential elements | Direct v. indirect infringement
         Defenses to infringement | Presumption of validity | Anticipation/novelty
         Subject matter eligibility | Inventive step/obviousness | Utility
         Sufficiency of description/ambiguity | Inventorship

Course instructors will walk students through hands-on exercises covering key principles of patent infringement and validity providing both practical skills and valuable tips for passing the exam.

** Students are required to attend the virtual workshops and lectures during the designated times.


 DISTANCE EDUCATION: FEBRUARY 6 – APRIL 10 | 2023

The initial lectures will be followed by 8 weeks of practice exercises, consisting of one exercise per week submitted via e-mail to an instructor for review. These assignments will involve approximately 5 hours of work per week.

COURSE PRE-REQUISITES

To obtain the optimum benefits from the course it is recommended that students have at least one year of experience or training in the areas of patent infringement and validity according to Canadian practice.

ATTESTATION OF COMPLETION

Students who complete and submit all practice exercises will receive an attestation of completion at the end of the course.

Tuition

IPIC Member: $2,400 plus applicable tax
Non Member: $2,700 plus applicable tax 

Enrollment is limited – should it become necessary to restrict the number of participants, preference will be given to those planning to sit for the 2023 Canadian Qualifying Patent Agent Exam.
