Exceptions to infringement for experimentation and prior use codified in section 55.3 and 56 of Canada’s Patent Act were amended in 2018. Limited Canadian judicial consideration has been given to these exceptions since the amendments. Join us for a discussion of these amendments, the existing Canadian legal landscapes, and gain insights as to the treatment of similar exceptions in the U.K. to help offer perspectives on how the Canadian exceptions may evolve.
