Intellectual property is mostly governed by federal jurisdiction in Canada but the provincial common law and civil law rules can often be critical to a client’s rights and obligations, due to the important differences between these two legal traditions. Intellectual property practitioners must thus take into account how these two traditions address certain issues of property and civil rights that are relevant to intellectual property. This webinar will address how the following subjects are treated differently under civil law and common law:

  • The legal nature of an IP licence agreement;
  • Retroactive assignment contracts;
  • The transfer of future (as-yet uncreated) IP; and
  • The rights and obligations of co-owners of a patent.
