Co-existence agreements are often necessary for brand owners, particularly when considering expansion of their products/services offering, domestically and into foreign markets. These types of agreements serve as an effective way to avoid or settle trademark disputes. Successfully negotiating co-existence agreements is critical for trademark practitioners. This webinar will explore co-existence agreements and issues that may arise. The learning objectives of this presentation are:

  •  Understanding when co-existence agreements are advisable compared to other options (e.g., consents or litigation);
  • Reviewing the key elements of a co-existence agreement;
  • Identifying pitfalls to avoid when negotiating co-existence agreements; and
  • Understanding the impact of co-existence agreements on a brand owner’s scope of rights.
