Accelerated Examination of an Industrial Design Application When There is a Priority Claim

CIPO proposed providing an earlier search as early as 6 months from the date of priority for priority-claiming applications, provided this will not prevent the registration of a design that is later filed.

IPIC's Position

IPIC is in favour of adopting the proposed change and recommends that it be applied to applications subject to normal examination. If the priority claim is found valid, CIPO should proceed with the search and formalities examination concurrently.
