In its consultation, the government has put forward a code that is based on IPIC’s draft revised code (with only small changes). Given the reference to privilege in the consultation paper and the early deadline for the comments on the code of conduct, we think that the government may want to use this draft revised code now to guide agents, before a new regulatory framework is put in place. It could for example be posted on CIPO’s website but there is no indication at this time that it would be added to the Patent Rules and Trade-marks Regulations.
